1 Service Content
ZOWEE TECHNOLOGY (HEYUAN) CO., LTD. (hereinafter referred to as "ZOWEE TECHNOLOGY", "we", "us", or "our") provides operation for mobile broadband devices and related technologies and functions (collectively, the "Services"). The Services provide a portal for controlling the mobile broadband devices of ZOWEE TECHNOLOGY, as well as user-friendly prompts and interaction that deliver a better user experience.
2 Special Notice
ZOWEE TECHNOLOGY hereby asks you to note that before using the Services, you shall read and comply with this user agreement, the privacy notice, and other policies and information published or made available through the Services (collectively, this "Agreement"). Please make sure to carefully read and fully understand the terms and conditions. Unless you have read and accepted all the terms and conditions in this Agreement, you do not have the right to use the Services.
Your access to or use of the Services shall be deemed as your agreement to and acceptance of this Agreement. If you do not accept and agree to this Agreement, you must not access or use the Services. If you have questions regarding this Agreement or other policies and information published or made available through the Services, please contact us using the contact information below.
3 Eligibility
You must reach the legal age of majority to use the Services. Therefore, your use of the Services shall be deemed as your commitment of being older than the legal age of majority. If you have not reached the legal age of majority, you need to read this Agreement with your parent or legal guardian before deciding to use the Services to ensure they clearly understand the content of this Agreement. Parents or legal guardians are advised to provide supervision and guidance for minor children when they use the Services. If you are a minor, you are permitted to use the Services only if you read this Agreement with your legal guardians and acquire their consent. You are subject to and solely responsible for obeying all laws and regulations of the jurisdiction in which you reside and from which you access or use any of the Services.
4 Accessing the Services
ZOWEE TECHNOLOGY grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services, subject to, and in accordance with, this Agreement.
You are responsible for making all arrangements necessary for you to have access to the Services, including providing your compatible device, console or platform, and Internet access. You are also responsible for ensuring that all users who access the Services through your compatible device, console or platform, and Internet access are aware of this Agreement, and that they comply with this Agreement in full at all times.
5 Software Update
ZOWEE TECHNOLOGY will provide automatic updates or upgrades for the Services. Such updates or upgrades require Internet access. Data usage fees incurred therefrom, if any, will be directly charged by the mobile carrier. For more information, please consult your carrier.
Your ZOWEE TECHNOLOGY device will automatically search for and download new update packages to provide you with timely update services. These updates are designed to fix cyber security loopholes and prevent new security threats. You acknowledge the importance of receiving and installing system security update patches in a timely manner. Due to the importance of such updates, your device may automatically install some downloaded updates. We strongly recommend that you keep the default configurations of your device to avoid software issues resulting from delayed updates. This function is enabled by default. To configure the auto-update feature of the device, log in to the WebUI product management page, and go to Advanced > System > System Settings > Auto Update .
6 Terms of Use
You hereby agree and undertake:
(1) Not to remove the copyright, trademark, or other proprietary notices from the Services;
(2) Not to reproduce, make alterations to, or modifications of, the whole or any part of the Services, or permit the Services or any part of them to be combined with, or become incorporated in, any other programs;
(3) Not to gain or attempt to gain unauthorized access to or impair any aspect of the Services or their related systems or networks;
(4) Not to modify, crack, decompile, disassemble, or reverse engineer the product, or release any modified, cracked, or otherwise unauthorized version of the product without the authorization of ZOWEE TECHNOLOGY;
(5) Not to use the Services (or any part(s) thereof) in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement, or act fraudulently or maliciously, including without limitation, by hacking into or inserting malicious code, including viruses, or harmful data, into the Services (or into the websites linked to the Services) or any operating system;
(6) Not to infringe upon the intellectual property rights of ZOWEE TECHNOLOGY or those of any third party in relation to your use of the Services;
(7) Not to collect users' information, or otherwise access the Services or ZOWEE TECHNOLOGY's systems, using automated means (for example, harvesting bots) or attempt to decipher any transmissions to or from the servers running the Services;
(8) Not to develop, support, or use software, devices, scripts, robots, or any other means or processes (including crawlers, browser plug-ins and add-ons, or any other technology or manual work) to scrape information from the Services or otherwise copy profiles and other data from the Services;
(9) Not to commercially exploit the Services without ZOWEE TECHNOLOGY's prior written consent;
(10) Not to use the Services in any manner which could damage, disable, overburden, impair, or compromise the Services, or ZOWEE TECHNOLOGY's systems or security, or interfere with other users or any other party's computer systems or hack or gain unauthorized access to the Services or ZOWEE TECHNOLOGY Content (defined below) or data.
7 Service Management and Control
To effectively operate and improve the Services (including but not limited to fraud prevention, risk assessment, investigation, and customer support), we reserve the right to review your content at any time to check whether it complies with this Agreement. If your content is found to be in violation of this Agreement, we have the right to modify and/or remove your content at any time without prior notice.
8 Disclaimers
The Services are for your sole use only and must not be used by any third party.
ZOWEE TECHNOLOGY will not be liable for any claim arising from interruptions, delays, disruptions, or similar failures during the course of providing services.
9 Limitation of Liability
If you are not satisfied with any aspect of the Services, your only remedy is to stop accessing and using the Services.
10 Termination or Suspension of the Agreement
We will immediately, permanently or temporarily, restrict, cancel, or terminate your access to part(s) or all of the Services in any of the following circumstances:
(1) If you violate this Agreement;
(2) If you act illegally, or provide ZOWEE TECHNOLOGY with any false information;
(3) As requested by law enforcement or other government agencies;
(4) In case of urgent maintenance work or urgent updates to systems or hardware;
(5) Due to unexpected technical, safety, business, or security reasons.
Any user whose use of or access to the Services has been suspended, terminated, or deactivated by ZOWEE TECHNOLOGY may not be able to access the Services without ZOWEE TECHNOLOGY's prior written consent.
The expiry or termination of this Agreement does not affect the provisions of this Agreement that are expressed to operate or have effect after the expiry or termination thereof, and is without prejudice to any accrued rights or obligations or any rights or obligations which are intended to survive such expiry or termination.
11 Updates
ZOWEE TECHNOLOGY may perform addition or removal operations on the Services, create new limits to the Services, or temporarily or permanently suspend or stop one of the Services.
We will determine whether to notify you within a reasonable period of time prior to the change, depending on the seriousness of the circumstances. For changes to the Services that we need to make to meet security, safety, legal, or regulatory requirements, we may not be able to meet the aforementioned timescales and we will update you about these changes as soon as is practicable.
If you continue to use the Services after the changes become effective, you will be deemed to have accepted those changes. If you do not agree to such changes, you must immediately cease to use the Services, and end your contractual relationship with ZOWEE TECHNOLOGY. Any amendment, variation, or modification to this Agreement you purport to make shall not be binding on ZOWEE TECHNOLOGY.
12 General Terms
If any part(s) of this Agreement is deemed as invalid by the court or other competent authorities, any other terms shall not be affected and shall continue to be enforceable and binding upon both parties to the fullest extent permitted by applicable law.
You agree that if ZOWEE TECHNOLOGY does not claim the performance or enforcement of any legal rights or remedies under this Agreement, it does not mean that ZOWEE TECHNOLOGY waives these rights or remedies, and that ZOWEE TECHNOLOGY still retains its rights to exercise them. These terms, including the privacy policy, user agreement, and any other terms established by law, constitute the entire agreement between you and ZOWEE TECHNOLOGY in respect of the use of the Services. This Agreement supersedes all prior oral and written agreements between you and ZOWEE TECHNOLOGY regarding the Services.
13 Governing Law and Dispute Resolution
The validation, interpretation, update, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China, without regard to its conflict of laws rules.
This Agreement is signed in High-tech Zone, Heyuan City. Any disputes arising from the performance or content of this Agreement between the two parties shall be settled through amicable negotiation. If the negotiation fails, either party can file a lawsuit with the people's court with proper jurisdiction in the place where this Agreement is signed.
